These Terms of Service ("Terms") govern your access to and use of UptimeHunt, a distributed uptime and service-monitoring platform. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
The service is operated by OpenHades Cloud Services Konrad Mosoń — Konrad Mosoń, an individual entrepreneur (jednoosobowa działalność gospodarcza) registered in the Polish CEIDG and based in Kraków, Poland (EU), NIP 8681952845, REGON 387960680 ("UptimeHunt", "we", "us", "our"). A postal address is available on request via the contact email below.
All questions, notices and requests relating to these Terms — including support, complaints, privacy and legal matters — should go to support@uptimehunt.io.
These Terms, together with our Privacy Policy, are made available to you in a form that lets you store and reproduce them (for example, by saving or printing this page). We provide our identifying details and the main characteristics of the service before you conclude the contract, so that you can review them before you accept.
1. Acceptance and Definitions
By registering for, accessing, or using UptimeHunt you accept these Terms and our Privacy Policy, which is incorporated by reference. If you are using UptimeHunt on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
In these Terms:
- "Service" means the UptimeHunt platform, including the dashboard and REST API (
app.uptimehunt.io), the documentation site (docs.uptimehunt.io), the MCP server (mcp.uptimehunt.io), the OAuth authorization server (auth.uptimehunt.io), the distributed probe network, and the marketing site (uptimehunt.io). - "Account" means your registered user account.
- "Monitoring Data" means the monitoring configuration you supply (targets, check settings, assertions, projects, probe locations) and the check results, incidents, alerts and audit records the Service generates from it.
- "Target" means any system, host, URL, IP address, port or service you configure UptimeHunt to monitor.
- "Probes" means the distributed nodes that execute your checks from multiple locations.
- "Consumer" means a natural person who uses the Service for purposes outside their trade, business, craft or profession.
2. Description of the Service
UptimeHunt is a SaaS monitoring platform that runs checks against Targets from a distributed network of Probes and reports availability, performance and incidents. The Service currently supports the following check types:
- HTTP/HTTPS checks (status codes, response time and phase breakdowns, TLS certificate chains and expiry, optional authenticated checks);
- Ping (ICMP RTT and packet loss);
- DNS record checks (A/AAAA/MX/TXT/NS/SOA/CNAME and TTLs, optional custom nameservers);
- SMTP checks (banner / EHLO capabilities);
- SSH checks (identification banner, version, host-key fingerprint);
- Game-server checks (Quake3, Source/A2S, GoldSource, Minecraft — including map, game type, player counts and roster).
The Service also provides multi-region monitoring with consensus across Probes (that is, agreement across multiple Probes before an outage is declared), incident tracking and alert rules, a REST API, an MCP server for AI clients, and optional Kubernetes auto-discovery (an operator that mirrors cluster Ingress hostnames/paths into HTTP checks, add/update only).
The Service is currently provided free of charge and in beta, "as is", and may change, be limited, or be discontinued. Features marked "Soon" (including additional alert integrations and paid plans) are not yet available; see Sections 9 and 10.
3. Eligibility
You must be at least 16 years old and have the legal capacity to enter into a binding agreement. The Service is not directed to children under 16, and we do not knowingly collect their data. If you act for an organization, you must be authorized to bind it.
4. Accounts and Security
To use the Service you create an Account with an email address and a password (stored only as a salted hash) and an optional name. You are responsible for:
- maintaining the confidentiality of your credentials and any API tokens;
- all activity that occurs under your Account;
- keeping your
uh_-prefixed API tokens and OAuth-connected app authorizations secret — these grant programmatic access to your data. Tokens are scoped and revocable; revoke any token you believe is compromised.
Notify us at support@uptimehunt.io promptly if you suspect unauthorized access. You must provide accurate Account information and keep it current.
5. Acceptable Use and Prohibited Conduct
This is the most important section of these Terms. UptimeHunt is a network monitoring tool that sends real requests to the Targets you configure, from Probes around the world. You must only point it at systems you are entitled to test.
You may configure checks only against Targets that:
- you own, or
- you are explicitly authorized by the owner to monitor or test.
You must not use UptimeHunt, its Probes, or its API to:
- attack, overload, flood, or deny service to any third-party system (including any form of DoS/DDoS or deliberately abusive request volume);
- port-scan, probe, enumerate, or otherwise investigate systems you do not own or are not authorized to test;
- circumvent authentication, access controls, rate limits, or security measures of any Target;
- engage in any illegal, infringing, fraudulent, deceptive, or abusive activity, or violate the rights of others;
- monitor a Target in violation of that Target's own terms of service, acceptable-use rules, or published access restrictions (including
robotsdirectives where applicable); - generate request rates beyond your plan's limits or beyond what the Target reasonably permits;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or other users' data; or
- use the Service to transmit malware or other harmful code.
You are solely responsible for ensuring you have authorization for every Target you configure, including any HTTP credentials, custom headers, or Kubernetes-discovered hosts you submit. Unauthorized scanning, probing, or attacking of third-party systems is strictly prohibited and may be unlawful.
Misuse — and in particular any use of Probes against systems you are not authorized to test — is grounds for immediate suspension or termination without notice. Where we reasonably believe activity is unlawful, we may report it to the relevant authorities (see Section 16). You agree to indemnify us for such misuse to the extent set out in Section 15.
6. Your Data and Ownership
As between you and us, you own your Monitoring Data. You retain all rights to your monitoring configuration and the results generated from it.
You grant UptimeHunt a limited, non-exclusive licence to host, process, transmit, and display your Monitoring Data solely to provide and operate the Service for you (including running checks from Probes, storing and serving results, generating incidents and alerts, and delivering notifications to destinations you choose). We do not sell your data.
Our processing of personal data is described in our Privacy Policy, including the legal bases we rely on under the GDPR, the data-subject rights available to you, our data-retention windows, our subprocessors, and how we handle transfers outside the EEA. You are responsible for ensuring you have a lawful basis to provide any personal data or third-party Target data you submit, and for any credentials you enter for authenticated checks.
Personal data within Monitoring Data (controller/processor roles). Where the Monitoring Data you configure includes personal data of third parties, you act as the data controller for that data and UptimeHunt acts as your processor, processing it on your documented instructions solely to provide the Service. Such processing is governed by a data-processing agreement meeting the requirements of Article 28 GDPR; a copy is available on request via support@uptimehunt.io.
7. Service Availability and Limitations of Monitoring
UptimeHunt is provided on the free/beta tier without any uptime guarantee, service-level agreement, or warranty of continuous availability. We may modify, suspend, or discontinue all or part of the Service at any time.
Honest limitation — a monitoring service can itself miss outages or report false alarms. No monitoring system is perfect. UptimeHunt can experience gaps in coverage, delayed checks, false positives (reporting a problem that does not exist) and false negatives (failing to detect a real outage), for reasons including Probe or network failures, configuration errors, third-party outages, and the inherent limits of distributed monitoring. UptimeHunt is a supplementary tool and is not a substitute for your own monitoring, redundancy, backups, and operational safeguards. You should not rely on UptimeHunt as your sole means of detecting or preventing service problems.
8. Third-Party Services and Targets
The Targets you monitor and the destinations you send alerts to (for example, Email and Webhook integrations today, with Slack, Discord, Telegram, Microsoft Teams, Google Chat and Mattermost coming soon) are third-party services governed by their own terms and policies. You are responsible for your use of, and your relationship with, those third parties, including any credentials, webhook URLs, and channel configuration you provide. We are not responsible for the availability, behaviour, or content of third-party Targets or alert destinations.
9. Plans, Fees and Billing
The Service is currently free of charge and in beta. No payment processor is connected and no paid plans are purchasable today. Paid tiers (Starter, Pro, Enterprise) are "Coming soon."
The following applies only when and if paid plans launch, and does not create any payment obligation now:
- Fees, billing cycles, automatic renewal, applicable taxes, and refund terms will be specified at the point of purchase before you subscribe.
- Payment details will be handled by a third-party payment processor; UptimeHunt does not currently store card data.
- Pricing and plan features may change, with reasonable advance notice.
- Until paid plans become available to you, these free/beta Terms govern, and the free tier terms prevail.
Plan-dependent limits (including data retention windows and request rates) are described in the Service and in our Privacy Policy. The Free tier is the only live tier today.
10. Beta Status
Because the Service is in beta, it may contain errors, be incomplete, change without notice, or be unavailable. Features may be added, changed, or removed. We welcome feedback at support@uptimehunt.io, but we are not obligated to act on it.
11. Consumer Right of Withdrawal
If you are a Consumer entering into a distance contract with us, you have the right to withdraw from that contract within 14 days without giving any reason. To exercise it, send a clear statement of your decision to withdraw to support@uptimehunt.io before the period ends.
The Service is currently free of charge, so withdrawal has no financial consequences today. This clause matters for paid subscriptions when they launch: if you ask us to begin providing a paid digital service before the 14-day period expires, you will be asked to expressly consent to performance starting early and to acknowledge that you lose the right of withdrawal once the service has been fully performed. Where performance has begun during the withdrawal period at your request and you then withdraw, you may be required to pay for what was provided up to that point, in proportion to the full contract.
12. Intellectual Property
The Service, including the UptimeHunt software, platform, documentation, design, and the UptimeHunt name and brand, is owned by OpenHades Cloud Services Konrad Mosoń and protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. No other rights are granted. You may not copy, modify, distribute, sell, or create derivative works of the Service except as expressly permitted.
This Section does not affect your ownership of your Monitoring Data (Section 6).
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, and subject to Section 15, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that monitoring results will be complete or accurate (see Section 7).
Nothing in this Section excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited, including mandatory rights of Consumers under EU and Polish law. If you are a Consumer, your statutory rights (including any statutory warranty or conformity rights) are not affected by this Section.
14. Limitation of Liability
To the maximum extent permitted by applicable law, and subject in all cases to Section 15 (Mandatory Protections That Cannot Be Excluded):
For business (non-Consumer) users:
- UptimeHunt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, including any missed outage, false positive, false negative, or monitoring gap (see Section 7).
- Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months preceding the event giving rise to the liability — which, while the Service is free, is zero. This cap and the exclusions above apply only to the extent permitted by applicable law.
For Consumers:
- The exclusions and the monetary cap above do not apply to you. Our liability towards Consumers follows the mandatory rules of Polish and EU law, and nothing in these Terms reduces it below what those rules require. The provisions of this Section are without prejudice to, and are always read subject to, Section 15.
15. Mandatory Protections That Cannot Be Excluded
Nothing in these Terms (and in particular Sections 13 and 14) excludes or limits our liability where it cannot be excluded or limited under applicable law. In particular:
- liability for intent (wilful misconduct) and gross negligence is not excluded;
- liability for death or personal injury caused by our negligence is not excluded;
- mandatory consumer-protection rights under EU law and Polish law remain fully in force for users who qualify as Consumers, and any limitations in these Terms apply to Consumers only to the extent permitted by those mandatory rules.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless OpenHades Cloud Services Konrad Mosoń from and against any claims, damages, losses, liabilities, and reasonable costs arising out of or related to:
- your misuse of the Service, in particular any monitoring, scanning, probing, or attacking of third-party systems without authorization (Section 5);
- your breach of these Terms or applicable law; or
- the Monitoring Data or credentials you submit, including any infringement of third-party rights.
If you are a Consumer, this Section applies only to the extent such an indemnity is permitted by applicable mandatory law, and it does not affect your statutory rights.
Where we reasonably believe activity carried out through your Account is unlawful, we may report it to law-enforcement or other competent authorities and cooperate with them.
17. Suspension and Termination
You may stop using the Service and close your Account at any time by contacting support@uptimehunt.io.
We may suspend or terminate your access, with or without notice, if you breach these Terms (in particular Section 5), if required by law, or to protect the Service, other users, or third parties. We will give reasonable notice where practicable and where required by law.
Effect of termination: on Account closure or termination, your access ends and your Monitoring Data is deleted according to the retention windows described in our Privacy Policy (raw probe results and incident history are retained for plan-dependent periods; Account data is deleted on closure), subject to any data we are legally required to retain. Sections that by their nature should survive — including Sections 5 (Acceptable Use), 6 (Your Data and Ownership), 7 (Limitations of Monitoring), 12 (Intellectual Property), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Mandatory Protections), 16 (Indemnification), 18 (Severability and General) and 19 (Governing Law) — survive termination.
18. Severability and General
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy and any terms presented at the point of purchase for paid plans, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms in connection with a reorganization, sale, or transfer of the Service, provided your rights under these Terms are not reduced; if you are a Consumer and such an assignment would adversely affect your rights, you may terminate by closing your Account.
Contract language. These Terms are provided in English. For Polish Consumers, a Polish-language version may be made available; where required by law, the Polish-language version governs the relationship with a Polish Consumer.
19. Governing Law, Jurisdiction and Disputes
These Terms are governed by the laws of Poland, without prejudice to any mandatory consumer-protection rules of the country in which a Consumer user resides.
For business (non-Consumer) users, disputes are subject to the exclusive jurisdiction of the Polish courts competent for the operator's place of business.
For Consumers, this choice of law and forum does not deprive you of the protection of the mandatory rules — or the more favourable jurisdiction rules — of your EU country of residence. Under EU rules, a Consumer may bring proceedings against us, and may generally only be sued by us, in the courts of the EU Member State in which the Consumer is domiciled.
Out-of-court dispute resolution. If you are a Consumer, you may also be entitled to use out-of-court dispute-resolution mechanisms. In Poland these include the Consumer-arbitration and mediation procedures available through the Trade Inspection (Inspekcja Handlowa) and the offices of municipal/district consumer ombudsmen (rzecznik konsumentów). Details of available bodies can be provided on request via support@uptimehunt.io.
Data-protection complaints. Independently of the above, if you believe we have processed your personal data unlawfully, you have the right to lodge a complaint with the Polish data-protection supervisory authority, the President of the Personal Data Protection Office — Urząd Ochrony Danych Osobowych (UODO), Warsaw, https://uodo.gov.pl. Our Privacy Policy describes your full data-subject rights.
